2008 South Dakota Pheasantennial Sweepstakes

Official Contest Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. THE CONTEST IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Contest Rules. The registration for the 2008 South Dakota Pheasantennial ("Contest") begins on August 28, 2008, and ends on November 15, 2008 at 9:59pm (CST) ("Contest Period"). Eight (8) Winners will be drawn from online and in-store entries received between August 18, 2008, and October 26, 2008 at 11:59pm (CDT) on or around October 28, 2008. Two (2) additional winners will be drawn from entries received on November 15, 2008 in Mitchell, SD, Cabela’s retail store between the hours of 7:00 am (CST) and 4:00pm (CST). Winners must be available to travel to Mitchell, SD, on November 15, 2008, to claim the prize in person. Contest is hosted by the South Dakota Office of Tourism, 711 E. Wells Ave., Pierre, SD 57501 ("Host").

Eligibility: Contest is open to all natural persons age 21 and older who are legal residents of the United States for the duration of the Contest. Employees, officers and directors of Host, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the Contest. Must be able to travel November 15, 2008, to be able to claim the prize in person. Must be present on November 15, 2008, from the hours of 5:00pm (CST) and 10:00 pm (CST) to qualify for and win the Grand Prize. Void where prohibited. All federal, state, and local laws and regulations apply.

How to Enter: No purchase necessary. On or about August 28, 2008, the Host will promote a free South Dakota Pheasantennial Sweepstakes using electronic, broadcast, print, and direct mail marketing efforts. Participants will be directed to the www.HuntInSD.com website and participating partner locations where they will be given the option to complete an online or paper entry form. Mandatory fields to be completed include first and last name, complete mailing address, telephone number, and e-mail address. By completing the online or paper entry form for the South Dakota Pheasantennial, the Participant agrees to receive promotional information from the Host and its partners. One entry per household. Duplicate entries will be removed before official drawings.

Host is not responsible for lost, late, misdirected, or non-delivered entries or for any miscommunication or technical failures as a result of contest participation. Upon receipt, entries become property of Host.

Entrants agree that the Host, it affiliates, directors, officers and agents are not liable for, and will be held harmless against, any and all claims to injury, loss or damage of any kind resulting directly or indirectly from participation in this contest or from acceptance or use of any prize.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS IN VIOLATION OF CRIMINAL AND CIVIL LAW. HOST RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Prize: A total of eight (8) unique winners will be chosen to each receive a $250 gas card, a $200 gift card to Cabela’s, and two nights of lodging to be used on November 14 and 15, 2008, or November 15 and 16, 2008, in Mitchell, SD. At the Pheasantennial Event in Mitchell, SD, on November 15, 2008, two (2) additional winners will be drawn from entries received onsite. Must be present to win. A total of two (2) unique winners will be chosen to each receive a $250 gas card, a $200 gift card to Cabela’s, and one night of lodging to be used on November 15, 2008, in Mitchell, SD. These ten (10) winners will be eligible to win a grand prize dream hunt for four in South Dakota given away on November 15, 2008. One grand prize winner will receive one (1) guided hunt for four (4) in South Dakota and a $500 Cabela’s gift certificate. The grand prize must be redeemed before December 31, 2009. Must be present to win.

Other expenses and/or services not specified are the sole responsibility of each winner. No alternative prize, cash, or other substitution is permitted. Prize is not transferable. All federal, state and/or local taxes are the sole responsibility of each winner.

Selection of Winners: Eight unique winners will be determined by random drawing from all eligible entries received by 11:59 pm (CDT) on October 26, 2008. All decisions are final and binding. Odds of winning will be determined by the number of participants. Winners will be notified at the time of the selection via e-mail or phone communication. An award notification will also be mailed to each winner. Winners have seven (7) days from the receipt of notification to accept the prize by confirming via email communication, written letter, or phone call to Buddy Seiner at the SD Office of Tourism, 711 E. Wells Ave., Pierre, SD 57501, (605) 773-3301 or buddy.seiner@state.sd.us . Host is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner or for late, lost, misdirected, or unsuccessful efforts of winner to claim prize. Any unclaimed prizes will become the property of the host.

Two (2) unique winners will be drawn in a random drawing held on November 15, 2008 in Mitchell, SD. Winners will be notified at the time of the selection via PA announcement and phone communication. Winners have 1 (one) hour from the receipt of notification to accept the prize by confirming via phone call or in person to Buddy Seiner at the SD Office of Tourism, (605) 280-4337. Host is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner or for late, lost, misdirected, or unsuccessful efforts of winner to claim prize. Any unclaimed prizes will become the property of the Host.

One (1) of the ten unique winners will be chosen in a random drawing for the grand prize Dream Hunt including a guided hunt for four (4) in South Dakota and a $500 Cabela’s gift certificate.

Winner will be required to sign and return a waiver of liability, indemnification and medical release at the time of prize claim in Mitchell, SD. At the time of prize claim, each winner will also need to provide a current government-issued photo identification to validate their identity and age as a winner. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, prize may be forfeited or an alternate winner selected.

Winners: The Registration Name of the potential winner(s) of the 2008 South Dakota Pheasantennial may be publicly announced, at the Host’s sole discretion, in any media for the duration of the sweepstakes period, but the Host has no obligation to do so.

Any potential prize winner whose name is announced publicly as the winner of the 2008 South Dakota Pheasantennial must still show proof of eligibility and qualify for the particular sweepstakes in order to accept the prize. Host is not obligated to select, or publicly announce, any alternative prize winner. By entering the sweepstakes, all entrants agree that their registration names may be announced publicly either after or prior to the Host’s notification to them that they are a potential prize winner and either after or prior to the Host’s determination of their eligibility or qualification for, or their acceptance of the prize. The Host reserves the right to disqualify any potential winner if such potential winner is determined to have been ineligible or unqualified.

Entrants and winners are solely responsible for their own actions relating to this Contest, and the acceptance and/or use of a prize. By participating in this Contest, and/or by acceptance or use of the prize, all entrants and winners agree to release and hold harmless Host, Sponsors and their parent, affiliates, subsidiaries, retailers, agencies, Contest sponsors and the respective officers, directors, employees and agents from and against any liability arising in connection with the Contest and/or use of the prize.

Winners List and Official Rules: To obtain a copy of the winners list or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to: South Dakota Office of Tourism, 711 E. Wells Ave., Pierre, SD 57501. Requests must be received no later than January 29, 2009.
