2008 South Dakota Fourth of July Vacation Giveaway

Official Contest Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. THE CONTEST IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Contest Rules. The 2008 South Dakota Fourth of July Vacation Giveaway ("Contest") begins on April 11, 2008, and ends on May 15, 2008, at 11:59 p.m. (CDT) ("Contest Period"). Contest is hosted by the South Dakota Office of Tourism, 711 E. Wells Ave., Pierre, SD 57501 ("Host").

Eligibility: Contest is open to all natural persons age 18 and older who are legal residents of the United States for the duration of the Contest. Employees, officers and directors of Host, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the Contest. Void where prohibited. All federal, state, and local laws and regulations apply.

How to Enter: No purchase necessary. On or about April 11, 2008, the Host will promote a free South Dakota Fourth of July Vacation Giveaway in newspaper and electronic marketing efforts. Participants will be directed to www.TravelSD.com/BlackHills. Participants are required to complete an online entry form. Mandatory fields to be completed include first and last names, complete mailing address, telephone number, and e-mail address. By completing the online entry form for the Contest, the participant agrees to receive promotional information by e-mail from the Host and its partners. Limit of one entry per household. Duplicate entries will be removed before the official drawing.

Host is not responsible for lost, late, misdirected, or non-delivered entries or for any miscommunication or technical failures as a result of contest participation. Upon receipt, entries become property of Host.

Participants agree that the Host, its affiliates, directors, officers and agents are not liable for, and will be held harmless against, any and all claims to injury, loss or damage of any kind resulting directly or indirectly from participation in this contest or from acceptance or use of any prize.

CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS IN VIOLATION OF CRIMINAL AND CIVIL LAW. HOST RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Prize: One winner will receive a gift certificate to include two nights of lodging in a family suite for up to four adults at the Best Western Golden Spike Inn and Suites, Hill City, SD; an “Official Guest Certificate” universal attraction pass for up to four adults from the Black Hills, Badlands & Lakes Association valid from June 30, 2008 through July 6, 2008; and up to four VIP tickets and a free parking pass for the Independence Day Celebration at Mount Rushmore National Memorial on July 3, 2008. Total Value: $4,250.00. The winner agrees to travel to South Dakota during the dates of July 3, 2008, through July 5, 2008.

Other expenses and/or services not specified are the sole responsibility of the winner. No alternate prize, cash, or other substitution is permitted. Prize is not transferable. All federal, state, and/or local taxes are the sole responsibility of the winner.

All lodging reservations must be made by winner by calling Best Western Golden Spike Inn and Suites at (800) 528-1234, following notification and prior to the vacation. Prize must be used by July 5, 2008. No extensions will be granted.

Selection of Winner: One winner will be determined by random drawing from all eligible entries received within 10 business days of the ending of the Contest Period. All decisions are final and binding. Odds of winning will be determined by the number of participants. Winner will be notified by telephone and/or e-mail at the time of the selection. An award notification will also be mailed to the winner. Winner will have 7 days from notification to accept the prize by U.S. Mail. Host is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner or for late, lost, misdirected, or unsuccessful efforts of winner to claim prize.

Winner and winner's traveling companion(s) will be required to sign and return waivers of liability, indemnification and medical release. A parent or guardian will be required to sign a waiver of liability, indemnification and medical release for each traveling companion below the age of majority. If the selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed documents as required, prize may be forfeited and an alternate winner selected.

Winner: The registration name of the potential winner of the Contest may be publicly announced, at the Host’s sole discretion, in any media for the duration of the Contest Period and immediately following for up to 30 days, but the Host has no obligation to do so.

Any potential prize winner whose name is announced publicly as the winner of the Contest must qualify for the Contest in order to accept the prize. Host is not obligated to select, or publicly announce, any alternative prize winner. By entering the Contest, all participants agree that their registration names may be announced publicly either after or prior to the Host’s notification to them that they are a prize winner and either after or prior to the Host’s determination of their qualification for, or their acceptance of the prize. The Host reserves the right to disqualify any potential winner if such potential winner is determined to have been unqualified.

Winners List and Official Rules: To obtain a copy of the winners list or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to: South Dakota Office of Tourism, 711 E. Wells Ave., Pierre, SD 57501. Requests must be received no later than July 25, 2008.
