Official Sweepstakes Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. THE SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Sweepstakes Rules. The registration for the 2012 Rooster Rush Hunt with Kent Hrbek and Tim Laudner Sweepstakes ("Sweepstakes") begins on August 1st, 2012, at 8:00 AM (CDT) and ends on September 30th, 2012, at 12:00 p.m. (CDT) ("Sweepstakes Period"). One (1) winner will be drawn from entries received between August 1st, 2012, and September 30th, 2012, on or around October 15th, 2012. Sweepstakes is hosted by the South Dakota Department of Tourism, 711 E. Wells Ave., Pierre, SD 57501 ("Host").

Eligibility: Sweepstakes is open to all natural persons age 18 and older (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age, such legal age of majority) who are legal residents of the United States for the duration of the Sweepstakes. Employees, officers and directors of Host, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the Sweepstakes. Void where prohibited. All federal, state, and local laws and regulations apply.

How to Enter: No purchase necessary. On or about August 1st, 2012, the Host will promote the Sweepstakes using electronic, broadcast, digital and print marketing efforts. Participants will have the option to register on-line at www.minnesotatwins.com, www.twinsbaseball.com or www.HuntInSD.com/Twins. Mandatory fields to be completed include first and last name, zip code and e-mail address. By completing the forms for the Sweepstakes, the Participant agrees to receive promotional information from the Host and its partners. Limit one (1) entry per person/e-mail address. Duplicate entries will be removed before official drawings. All information submitted online by entrants is subject to, and will be treated in a manner consistent with, the South Dakota Department of Tourism’s Terms of Use and Privacy Policy.

The Released Parties (defined below) are not responsible for lost, late, misdirected, or non-delivered entries or for any miscommunication or technical failures as a result of Sweepstakes participation. Upon receipt, entries become property of Host.

Entrants agree that the Host, the Minnesota Twins, and the other MLB Entities (defined below) and each of their respective affiliates, subsidiaries, licensees, retailers, distributors, directors, officers and agents (collectively, the “Released Parties”) are not liable for, and will be held harmless against, any and all claims to injury, loss or damage of any kind resulting directly or indirectly from participation in this Sweepstakes or from acceptance or use of any prize. “MLB Entities” shall mean MLB Advanced Media, L.P. (“MLBAM”), the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, the Major League Baseball Clubs (“Clubs”), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc.,  each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS IN VIOLATION OF CRIMINAL AND CIVIL LAW. HOST RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Prize: A total of one (1) grand prize winner will be chosen to receive a 2 day/3 night pheasant hunt at R&R Pheasant Hunting near Seneca, SD, for the winner and three friends (est. retail value ((“ERV”) of $6,000). The winner and three friends will hunt with Kent Hrbek and Tim Laudner for one (1) of the two (2) days. The winner will also receive one (1) Benelli Montifeltro 12 gauge (ERV of $1,000) courtesy of Pheasants Forever. Taxes, fees and transportation to South Dakota and R&R Pheasant Hunting are not included. A South Dakota pheasant hunting license is required to hunt but not included in the official prize package.  Winner and guests are responsible for all fees, taxes and regulations associated with obtaining a South Dakota pheasant hunting license. If winner does not participate or accept any part of the Sweepstakes prize, there will be no refund of cash.

Estimated Total Retail Value: $7,000. Winner agrees to travel to South Dakota for the dates of the hunt which will be Monday, December 10th – Thursday, December 13th 2012.

Other expenses and/or services not specified are the sole responsibility of each winner. No alternative prize, cash, or other substitution is permitted. Prize is not transferable. All federal, state and/or local taxes are the sole responsibility of the winner.

Selection of Winners: One winner will be determined by random drawing from all eligible entries on or around October 15th, 2012. All decisions are final and binding. Odds of winning will be determined by the total number of eligible entries. Winner will be notified at the time of the selection via e-mail and/or phone communication. An award notification will also be mailed to the winner. Winner will have seven (7) calendar days from e-mail and/or phone notification to accept the prize by email or phone. The Released Parties are not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner or for late, lost, misdirected, or unsuccessful efforts of winner to claim prize.

Winner and winner's traveling companions will be required to sign and return waivers of liability, indemnification and medical release. If winner is not of the age of majority in the state of residence, prize may be awarded in the name of a parent or guardian and that parent or guardian will be required to sign the waiver of liability, indemnification and medical release. A parent or guardian will be required to sign a waiver of liability, indemnification and medical release for each traveling companion below the age of majority. If the selected winner cannot be contacted, is ineligible, or fails to claim a prize, prize may be forfeited or an alternate winner selected. An unclaimed prize will become the property of the Host.

Winners: The Registration Name of the potential winner(s) of the Sweepstakes may be publicly announced, at the Host’s sole discretion, in any media for the duration of the Sweepstakes period, but the Host has no obligation to do so.

Any potential prize winner whose name is announced publicly as the winner of the Sweepstakes must show proof of eligibility and qualify for the particular Sweepstakes in order to accept the prize. Host is not obligated to select, or publicly announce, any alternative prize winner. By entering the Sweepstakes, all entrants agree that their registration names may be announced publicly either after or prior to the Host’s notification to them that they are a potential prize winner and either after or prior to the Host’s determination of their eligibility or qualification for, or their acceptance of the prize. The Host reserves the right to disqualify any potential winner if such potential winner is determined to have been ineligible or unqualified.

Entrants and winners are solely responsible for their own actions relating to this Sweepstakes, and the acceptance and/or use of a prize. By participating in this Sweepstakes, and/or by acceptance or use of the prize, and/or any travel or activity related to the receipt or use of the prize, all entrants and winners agree to release and hold harmless the Released Parties, Sponsors, affiliates, subsidiaries, retailers, agencies, Sweepstakes sponsors and the respective officers, directors, employees and agents from and against any liability arising in connection with the Sweepstakes and/or use of the prize.

General Conditions: Host, the Minnesota Twins (the “Twins”) and MLBAM reserve the right, in their sole discretion, to cancel or suspend the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes (or any portion thereof). Host, the Twins and MLBAM also reserve the right, in their sole discretion, to modify these Official Sweepstakes Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

Winners List and Official Rules: To obtain a copy of the winners list or a copy of these Official Sweepstakes Rules, send your request along with a stamped, self-addressed envelope to: South Dakota Department of Tourism, 711 E. Wells Ave., Pierre, SD 57501.

Requests must be received no later than October 30th, 2012.
